Labour and Employment

The department of Employment Law and Industrial Relations of Legance comprises highly-specialised lawyers.

The department's lawyers have been operating as a team for almost 20 years, thus developing an uncommon level of cohesion and organisation. They combine their own expertise with that present within Legance's other practice areas, in particular with respect to corporate, contractual, regulatory, tax, insolvency and restructuring matters.

The department's key areas of expertise include restructurings and redundancies, the availability and use of welfare support programs, transfers of undertakings, and outsourcing processes. In these contexts, Legance lawyers advise clients in the process of their strategic decision-making; on the identification of the tools that best serve their purpose; in negotiations with the trade unions and in drafting the resulting agreements. There is also specialist advice on the definition of collective labour agreements at company level, including agreements contracting out of statutory rules.

The team also advises on the drafting of contractual documents governing the appointment and termination of senior executives, including for listed companies and/or companies operating within regulated markets, and has uncommon expertise on non-competition and retention agreements.

The department also regularly advises its clients on litigation on every aspect of labour law and industrial relations, including issues of particular sensitivity and complexity.
